PEND OREILLE RIVER 10 BR 94 SHORELINE

STABILIZATION PROJECT

Priest River Wildlife Management Area, Bonner County, Idaho

The public is invited to comment on the Draft Environmental Assessment (EA) for the Pend Oreille River 10 BR 94 Shoreline Stabilization Project, Bonner County, Idaho. The project is located upstream of the Albeni Falls Dam approximately 1.5 miles east of the town of Priest River. The proposed action is rock rip/rap bank stabilization along approximately 600 linear feet of Pend Oreille River shoreline. The stabilization will prevent further encroachment into the Burlington Northern / Montana Rail Link and prevent further shoreline erosion that results in loss of important archaeological data. The Draft EA will be available at the East Bonner County Library, 1407 Cedar Street, Sandpoint, Idaho (208) 263-6930. The EA can also be viewed on the U.S. Army Corps of Engineers website at www.nws.usace.army.mil/ers/envirdocs.html. Comments will be received for 30 days and due no later than 24 June 2005. All comments received during the review period will be addressed in the Final EA. AMENDING COMMERCIAL "D" HEIGHT LIMIT WITH CUP

AN ORDINANCE OF THE CITY OF SANDPOINT, IDAHO, AMENDING TITLE 9, CHAPTER 3, SECTION 6, TO ALLOW THE MAXIMUM BUILDING HEIGHT ALLOWED IN THE COMMERCIAL "D" ZONE TO BE INCREASED FROM FORTY-FIVE FEET (45') TO SIXTY FEET (60') WITHIN SPECIFIED AREAS ZONED COMMERCIAL "D" WITH A CONDITIONAL USE PERMIT OR AS PART OF AN APPROVED PLANNED UNIT DEVELOPMENT; PROVIDING STANDARDS FOR SUCH APPROVAL; REPEALING PRIOR INCONSISTENT PROVISIONS; PROVIDING THAT THIS PROVISION SHALL BE DEEMED SEVERABLE AND THAT REMAINING SECTIONS OF SANDPOINT MUNICIPAL CODE SHALL NOT BE AFFECTED BY A FINDING THAT THIS PROVISION IS UNLAWFUL OR UNENFORCEABLE; AND PROVIDING FOR PUBLICATION AND AN EFFECTIVE DATE.

SECTION 1 Allows buildings or structures to be constructed to a height greater than forty-five feet (45'), with maximum height not to exceed sixty feet (60') with a Conditional Use Permit within specified areas zoned Commercial "D"; also design appropriate for the site with design in accordance with guidelines to consider open space, landscaping, siting, pedestrian amenities, architectural design and materials, parking amenities, providing beneficial uses, safety and fire considerations, solar and view access and historic status. Areas within the Commercial "D" zone where the conditional use is authorized include: (a.) East of Boyer Avenue, west of the BNSF RR tracks, north of Larch Street, and south of the BNSF RR tracks; (b.) Commercial "D" Overlay Zone area south of Cedar Street (see map). SECTION 2 provides for severability; SECTION 3 provides an effective date.

The full Ordinance is on file with the Sandpoint City Clerk and will be promptly provided during regular business hours to any citizens on personal request.
