NOTICE OF TRUSTEE'S SALE

On Thursday, August 11, 2005 at the hour of 10:30 o'clock A.M., of said day, in the office of Alliance Title & Escrow Corp located at 105 Pine Street, Sandpoint, Id 83864.

Alliance Title & Escrow Corp, as trustee, will sell at public auction, to the highest bidder, for cash, cashier's check, certified check or tellers check (from a bank which has a branch in the community at the site of the sale), money order, State of Idaho check or local government check, or cash equivalent in lawful money of the United States, all payable at the same time of sale, the following described real property, situated in the County of Bonner, State of Idaho, and described as follows, to wit:

The Northeast Quarter of the Southeast Quarter of the Northeast Quarter of Section 20, Township 55 North, Range 2 West, Boise Meridian, Bonner County, Idaho;

Except that portion of said Northeast Quarter lying within a strip of land 25 feet in width along the East line thereof, as conveyed to the County of Bonner for purposes of a public road by deed recorded November 20, 1915 in Book 31 of Deeds, Page 113, records of Bonner County, Idaho.

THE TRUSTEE HAS NO KNOWLEDGE OF A MORE PARTICULAR DESCRIPTION OF THE ABOVE-DESCRIBED REAL PROPERTY, BUT FOR PURPOSES OF COMPLIANCE WITH IDAHO CODE, SECTION 60-113, THE TRUSTEE HAS BEEN INFORMED THAT THE STREET ADDRESS OF: 2438 Blacktail Road, Cocolalla, ID 83813, MAY SOMETIMES BE ASSOCIATED WITH SAID REAL PROPERTY.

If the successful bidder cannot provide the bid price by means of one of the above means of payment, the sale will be postponed for 10 minutes only to allow the high bidder to obtain payment in a form prescribed herein above. If the high bidder is unsuccessful in obtaining payment as directed within 10 minutes, the sale will be re-held immediately and any bid by the high bidder from the previous sale will be rejected, all in accordance with Idaho Code 45-1502 et.Sec.

Said sale will be made without covenant or warranty regarding title, possession or encumbrances to satisfy the obligation secured by and pursuant to the power of sale conferred in the deed of trust executed by Kentucky S. Tarbert and Jennifer L. Tarbert, Husband and Wife, as Grantor to Alliance Title & Escrow Corp., as Trustee, for the benefit and security of Kootenai Investment Co., Inc as successor Beneficiary, recorded November 12, 1996 as Instrument No. 494899, COMPLY WITH SECTION 45-1506(4)(a), IDAHO CODE. NO REPRESENTATION IS MADE THAT THEY ARE, OR ARE NOT, PRESENTLY RESPONSIBLE FOR THIS OBLIGATION.

The default which this sale is to be made is failure to:

Make principal and interest payments as set forth on said Deed of Trust and Promissory Note.

The original loan amount was $26,300.00 together with interest thereon at the rate of 10% per annum as evidenced in Promissory Note dated November 8, 1996. Payments are in default for the months of September 2004 through and including March 2005 in the amount of $285.00 per month and continuing each and every month thereafter until the date of sale or reinstatement. The principal balance as of April 1, 2005 is $15,750.88 together with accrued and accuring interest thereon at the rate of 10% per annum. The per diem is $4.315. In addition to the above, there is also due delinquent real property taxes for 2002 and 2003, together with penalty and interest, and any other real property taxes that may become delinquent during this foreclosure; any late charges, advances, escrow collection fees, attorney fees, fees or costs associated with this foreclosure.

The balance owing as of this date on the obligation secured by said deed of trust is $15,750.88, excluding interest, costs and expenses actually incurred in enforcing the obligation thereunder or in this sale, as trustee's fees and/or reasonable attorney's fees as authorized in the promissory note secured by the aforementioned Deed of Trust.
