Notice is hereby given that on October 20, 2005, in the above-styled case, Criminal No. CR05-0310RSM, the United States District Court for the Western District of Washington, the Honorable Ricardo S. Martinez presiding, a Preliminary Order of Forfeiture was entered forfeiting the following property to the United States of America:

1. Real property in Boise, Idaho, together with its building, improvements, appurtenances, fixtures, attachments and easements, more specifically described as:

The East half (E/2) of the Southwest Quarter (SW/4) of the Northwest Quarter (NW/4) of Section Twenty-Three (23), Township Fifty-Four (54) North, Range Five (5) East, Boise, Meridian, Bonner County, Idaho.

2. $508.93 in U.S. Currency seized from Account Number XXX-XXX730-5 at Washington Mutual Bank held in the name of Betty Hoffert.

3. $242.47 in U.S. Currency seized from Account Number XXX-XXX596-3 at Washington Mutual Bank held in the name of Frank Hoffert.

4. $1,391.26 in U.S. Currency seized from Account Number XXXXX7378 at Wells Fargo Bank held in the name of Betty Hoffert.

5. $1,099.38 in U.S. Currency seized from Account Number XXX-XX2502 at Bank of West held in the name of Betty Hoffert.

The United Stated of America hereby gives notice of its intention to dispose of the forfeited properties in such a manner as the Attorney General may direct.

Pursuant to Title 21, United States of America Code, Section 853, any person other than the defendants having or claiming a legal right, title or interest in the forfeited property must file a petition within thirty (30) days of the final publication of this notice or personal receipt of notice, whichever is earlier. The petition shall be signed by the petitioner under penalty of perjury and shall set forth the nature and extent for the petitioner's right, title or interest in the forfeited property, the time and circumstances of the petitioner's acquisition of the right, title and interest in the property, and any additional facts supporting the petitioner's claim, and the relief sought. The original petition should be sent to the Clerk, United States District Court, 700 Stewart Street, Washington, 98101, and a copy should be sent to United States Attorney's Office, Attention: Forfeiture Unit, 700 Stewart Street, Suite 5220, Seattle, Washington 98101-1271.
