LAWRENCE & PATRICIA PEAK ZONE CHANGE ZC321-05

AN ORDINANCE OF BONNER COUNTY, IDAHO, CITING ITS AUTHORITY, AND PROVIDING FOR THE AMENDMENT OF THE OFFICIAL ZONING MAP OF BONNER COUNTY BY THE RECLASSIFICATION OF LANDS GENERALLY LOCATED IN SECTION 25, TOWNSHIP 57 NORTH, RANGE 3 WEST FROM RURAL TO CONDITIONAL INDUSTRIAL, AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, the Bonner County Planning and Zoning Commission did hold a public hearing on April 13, 2006, on the ZC321-05 request for a change in zoning designation according to the requirements for such hearings set forth at Section 67-6509, Idaho Code, and at Title 12, Bonner County Revised Code; and

WHEREAS, the Bonner County Planning and Zoning Commission did find that the zone change request ZC321-05 is in accordance with the Bonner County Comprehensive Plan and did recommend to the Board of County Commissioners that the zone change request be approved; and

WHEREAS, the Board of County Commissioners did hold a public hearing on June 14, 2006, on the ZC321-05 request for a change in zoning designation according to requirements of such hearings set forth at Section 67-6509, Idaho Code and at Title 12 of the Bonner County Revised Code; and

WHEREAS, the Board of County Commissioners did find that the zone change request ZC321-05 is in accordance with the Bonner County Comprehensive Plan;

WHEREAS, the Board of County Commissioners did also establish conditions of approval in authorizing the zone change, which require the execution of a developers' agreement, which has been completed and recorded at Instrument #706700, records of Bonner County, Idaho.

NOW, THEREFORE BE IT ORDAINED, by the Board of County Commissioners that the following be and is hereby adopted as an ordinance of Bonner County, Idaho:

SECTION 1: AUTHORITY

This ordinance is adopted pursuant to authority granted to Bonner County at Chapter 65 of Title 67, Idaho Code.

SECTION 2: AMENDING THE OFFICIAL ZONING MAP

The Official Zoning Map of Bonner County, Idaho is hereby amended by the reclassification of the following described lands from Rural to Conditional Industrial:

That portion of land lying in the Southeast quarter of the Southwest quarter of Section 25, Township 57 North, Range 3 West, Boise Meridian, Bonner County, Idaho, being a portion of the parcel described in Quitclaim Deed Instrument No. 608242, records of Bonner County, Idaho, and more particularly described as follows: Commencing at the Northeast corner of the tract of land described in said Quitclaim Deed Instrument No. 608242; thence South 00°45'25" East along the east line of said parcel, a distance of 1700 feet, more or less, to the Southeast corner of the parcel described in Bonner County Commissioners Resolution No. 91-28 (see Exhibit A, described below), and the true Point of Beginning; thence continuing South 00°45'25" East along said easterly line, a distance of 685 feet, more or less, to the Northerly right of way line of Highway 2; thence Westerly along said right of way to a point which bears South 00°45'25" East along the southerly extension of the West line of said Bonner County Commissioners Resolution No. 91-28 from the Southwest corner of said Bonner County Commissioners Resolution No. 91-28; thence North 00°45'25" West a distance of 735 feet, more or less, to said Southwest corner; thence South 89°55'32" East, a distance of 600 feet, more or less, along the South line of said Bonner County Commissioners Resolution No. 91-28, to the Point of Beginning.

This ordinance shall be in full force and effect upon its passage, approval and publication in one (1) issue of the Bonner County Daily Bee Newspaper, and upon the entry of the above described zoning reclassification upon the Official Zoning Map or a Supplemental Zoning Map in accordance with the provisions set forth at Chapter 4 of Title 12 of the Bonner County Revised Code.

ORDINANCE 478

PRIVATE ROAD

STANDARDS ORDINANCE

BONNER COUNTY, IDAHO

AN ORDINANCE OF BONNER COUNTY, IDAHO, SETTING FORTH ITS AUTHORITY; AMENDING CHAPTER 23 OF TITLE 12, BONNER COUNTY REVISED CODE, BY PROVIDING STANDARDS FOR PRIVATE ROADS FOR SUBDIVISIONS, PROVIDING FOR SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE.

SUMMARY:

Section 1 Ordinance #478 of Bonner County is an ordinance passed under the authority granted at Idaho Code, Title 67, Chapter 65 and provides for the adoption or amendment of certain land use standards of Title 12, Chapter 23, of the Bonner County Revised Code (BCRC). The ordinance provides the following:

A. BCRC 12-2305 paragraphs (c), (d) and (h) have been amended to require road networks within new subdivisions be designed and constructed to meet the minimum private or public road standards; to provide legal access which shall be developed to the minimum public or private standards and that roads built for private dedication be built to the minimum standards of a new Appendix "A" of Chapter 23, the "Private Road Standards Manual of Bonner County, Idaho."

B. The Private Road Standards Manual:

(1) Defines county, driveway, local fire agency, new road, project engineer, road surface, roadway and travelway.

(2) Requires construction of new private roads and existing private roads constructed or reconstructed for new subdivisions be built to the private road standards.

(3) Requires new roads be designed to meet the transportation component of the Comprehensive Plan and connect to local access and collector roads.

(4) Establishes specifications for road improvement drawings.

(5) Sets minimum standards for private road easement/right-of-way widths to be of sufficient width to accommodate cut, fill, snow storage and stormwater features, but not less than 30 feet wide, and to be designed to minimize the need for dead-ends and that cul-de-sacs and turn-arounds meet the current edition of International Fire Code.

(6) Establishes the maximum and minimum design parameters for new roads, including grade, curvature, width, surface type, travel width and roadway width.

(7) Sets standards for intersection design and visibility.

(8) Establishes road construction practices regarding clearing and grubbing, erosion control, subgrade, ballast, top course, road signage, new bridge construction, engineering requirements regarding inspections, final reports and as-built drawings.

(9) Creates an inspection and information checklist to be completed by the project engineer.

C. The Private Road Standards Ordinance will be effective upon the publication of this ordinance summary in one (1) issue of the Bonner County Daily Bee newspaper.

Non-Motorized Vessel Zone Ordinance No. 480

AMMENDING ORDINANCE #438 REGULATING THE OPERATION OF WATERCRAFT ON THE PUBLIC WATERS OF BONNER COUNTY, IDAHO; SETTING FORTH AUTHORITY THEREFORE; PROVIDING CERTAIN DEFINITIONS OF TERMS; ESTABLISHING A NON-MOTORIZED VESSEL ZONE FOR OPERATION OF WATERCRAFT; PRESCRIBING PENALTIES FOR VIOLATIONS; SPECIFYING SEVERABILITY OF SECTIONS OF ORDINANCE; ESTABLISHING AN EFFECTIVE DATE.

WHEREAS, authority to enact this Ordinance is granted to Bonner County pursuant to Idaho Code S67-7031(3); and,

WHEREAS, it is necessary for the protection of the health, safety, and welfare of the general public, and for the protection of public and private property, to regulate the operation of watercraft on the public waters of the State of Idaho situated in Bonner County, Idaho, but outside the municipal boundaries of the various incorporated cities within said county; and,

WHEREAS, the Board of Commissioners specifically finds that it is necessary for the protection of the health, safety, and welfare of the general public to adopt and enforce rules and regulations governing all County owned or controlled public waters; and,

WHEREAS, Bonner County Public Waters Ordinance 406 specifically grants to the Board of Commissioners the authority to designate a specific area on the public waterways of Bonner County as a restricted zone: and,

WHEREAS, the Board of Commissioners specifically recognizes the potential threat to the health, safety, and welfare of the general public and to public and private property, as well as wildlife habitats and natural vegetation, in the area commonly known as Pack River Flats

THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF BONNER COUNTY, IDAHO:

That the area of the Pack River Flats extending from the State Highway 200 bridge, over the Pack River, downstream to the Burlington Northern Santa Fe railway bridge is designated as a no-wake zone where speed is limited to no more than five (5) miles per hour, which shall extend from shoreline to opposite shoreline, encompassing all the water area between; and,

The Pack River upstream of the Highway 200 bridge is designated a non-motorized vessel zone, which shall extend from shoreline to opposite shoreline, encompassing all the water area between; and,

Further, that no vessel is allowed by this ordinance to use any kind of motor as a means of artificial propulsion in those waters of the Pack River herein designated a non-motorized vessel zone; and,

Further, this ordinance shall not apply to activities authorized by or undertaken by the Idaho Department of Fish and Game in the performance of its official business, to activities authorized by or undertaken by the United States Army Corps of Engineers in the performance of its official business, to activities authorized or undertaken by the Bonner County Sheriff's Department in the performance of its official business, or to emergency response activities.

DEFINITIONS: For the purpose of this Ordinance, the following definitions shall be applicable:

a) Public Waters shall mean any river, lake, or other body of water within Bonner County, Idaho, other than those, which are entirely privately owned, regardless of navigability.

b) Non-Motorized Vessel Zone shall mean a zone in which a vessel may not employ any type of motor as a means of propulsion of said vessel. This shall include combustion, electric, solar, or any mechanical means for providing artificial propulsion.

c) Vessel shall mean every description of watercraft, including a seaplane on the water, used or capable of being used as a means of transportation on water, but does not include float houses, diver's aids operated and designated primarily to propel a diver below or modified to be used as a means of transportation on the water, such as inflatable: air mattress, single inner tubes, and beach and water toys.

d) Shoreline shall mean the line of demarcation between water and land at the time in question without regard to property lines or high or low water lines or marks.

NON-MOTORIZED VESSEL ZONE—VIOLATIONS:

A. It shall be unlawful to operate a vessel in a manner that is contrary to the restrictions as set forth in this Ordinance passed by the Bonner County Board of Commissioners.

PENALTIES:

A. Unless otherwise provided by law, any person in violation of this ordinance shall be guilty of a misdemeanor, and subject to a fine not more than $300.00, and may be imprisoned for a term not to exceed six (6) months, or shall be subject to both such fine and imprisonment

SEVERABILITY:

A. If any of the provisions or sections of this Ordinance, or the application thereof to any person or circumstance is held by any court to be invalid or unconstitutional, such decision shall not affect the validity of the remaining provisions or sections.

EFFECTIVE DATE:

A. This Ordinance shall take full force upon its approval, passage, and publication in one edition of the Bonner Daily Bee, a newspaper of general circulation within Bonner County, Idaho.
