6:15 P.M. - FILE C906-08 - CONDITIONAL USE PERMIT FOR A PUBLIC UTILITY COMPLEX FACILITY (PUCF) - SAGLE VALLEY WATER & SEWER DISTRICT is seeking a conditional use permit for a public utility complex facility to allow for the construction and operation of a water system and installation of transmission lines in the general area of Sagle. The area encompasses ±590 acres annexed into the new Sagle Valley Water and Sewer District. The transmission lines will be installed throughout the Sagle Valley Water & Sewer District boundaries, encompassing Section 9 in the vicinity of Gun Club Road right-of-way, and Sections 10, 15 and 16, all of Township 56 North, Range 2 West, B.M.

LEGAL NOTICE

The Idaho Department of Fish and Game was informed by the Bureau of Fisheries that incidental take of non-adipose clipped adult Chinook salmon in Snake River fishery from the Dug Bar boat ramp to Hells Canyon Dam is greater than anticipated in the preseason fishery plan. A portion of the non-adipose clipped Chinook salmon encountered in the Snake River fishery originate from natural populations listed as threatened under the Endangered Species Act (ESA). Incidental take of ESA listed Snake River spring/summer Chinook salmon is authorized for recreational fisheries in the State of Idaho under National Oceanic and Atmospheric Administration (NOAA) Permit 1481. The permit was issued to the Idaho Department of Fish and Game under Section 10 of the Endangered Species Act. The permit limits total allowable incidental take of ESA listed Snake River spring/summer Chinook salmon based on a sliding scale of abundance of adult natural origin fish passing over Lower Granite Dam on the Snake River. Incidental take of natural origin adult fish in the Snake River fishery from Dug Bar boat ramp upstream to Hells Canyon Dam must be included in the estimated total take for adult Spring Chinook salmon that is authorized in Permit 1481. Whereas the pre-season plan for all Idaho Chinook salmon fisheries projected an incidental take of only one ESA listed Chinook salmon in the fishery from Dug Bar boat ramp to Hells Canyon Dam, inseason monitoring data indicate that the ESA take in that fishery will be greater than one. Additional incidental take of ESA listed fish in the Snake River fishery will constrain angler access to returns of hatchery fish in other Chinook salmon fisheries in Idaho. Therefore, the Bureau of Fisheries recommends closure of the Chinook salmon fishery in the Snake River from Dug Bar boar ramp to Hells Canton Dam effective one hour after sunset on June 22.

Pursuant to his authority under Idaho Code Section 36, 106(e)6A, the Idaho Department of Fish and Game Director hereby closes the Chinook salmon season on the Snake River (from the Dug Bar boat ramp upstream to Hells Canyon Dam) on June 22, 2008 at 9:44 PM Pacific Daylight Time.

The Idaho Department of Fish and Game was informed by the Bureau of Fisheries that by June 22 it is likely that anglers in the Middle Fork Clearwater River will catch the remainder of the non-tribal fishery share of adult Chinook salmon returning to the Kooskia Hatchery. Anglers in the Middle Fork Clearwater also harvest fish destined for hatchery satellite facilities in the Lochsa and South Fork Clearwater rivers. To ensure that the anglers do not harvest more than the non-tribal share of fish destined for Kooskia Hatchery, and to provide opportunities for Chinook salmon fishing in upstream tributaries in the Clearwater River drainage, the Bureau of Fisheries recommends closure of the Middle Fork Clearwater River Chinook salmon fishing season at the end of Chinook salmon fishing hours on June 22.

Pursuant to his authority under Idaho Code Section 36, 106(e)6A, the Idaho Department of Fish and Game Director hereby closes the Chinook salmon season on the Middle Fork Clearwater River (from the South Fork Clearwater River upstream to the confluence of the Lochsa and Selway rivers) on June 22, 2008 at 9:44 PM Pacific Daylight Time.
