Man faces rape charge

SANDPOINT — A Washington state man was arrested earlier this month on allegations that he raped an acquaintance while camping in the Hoodoo Valley.

Kim Michael Smith is being held in lieu of $250,000 while awaiting a preliminary hearing on charges of rape and forcible penetration with a foreign object.

The alleged victim, 28, told a Bonner County sheriff’s deputy that she awoke on June 9 to Smith pinning her wrists down and stating, “This is going to happen now.”

The woman said Smith, a 65-year-old Spokane resident, ordered her to disrobe and perform oral sex on him. She told the deputy she complied with Smith’s demands because she feared she would be harmed, according to a probable cause affidavit. He also fondled the woman’s genitalia and sodomized her, the affidavit states.

A criminal complaint states that the woman didn’t resist because of threats and/or great bodily harm.

Smith told the deputy that he has known the alleged victim for years and that they were in a romantic relationship. The woman, however, said they were only friends and that he was well aware that she had no interest in a sexual relationship, the affidavit said.

Court documents indicate that Smith was charged with kidnapping, rape and robbery in Seattle in 1975 and was given a life sentence. He was later convicted of rape in Snohomish County in 1990 and ended up serving a 96-month sentence, court records show.
