CITY OF KOOTENAI, IDAHO SUMMARY OF ORDINANCE #214 GRADING, EROSION CONTROL, AND STORMWATER MANAGEMENT REGULATIONS TITLE 7, CHAPTER 2, KOOTENAI CITY CODE TITLE: AN ORDINANCE OF THE CITY OF KOOTENAI, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, REPEALING TITLE 7, CHAPTER 2 OF KOOTENAI CITY CODE (STORMWATER REGULATIONS) AND ADOPTING A NEW TITLE 7, CHAPTER 2, GRADING, EROSION CONTROL, AND STORMWATER MANAGEMENT REGULATIONS TO PROVIDE: PURPOSE; AUTHORITY; DEFINITIONS; APPLICABILITY, ADMINISTRATION; AND ADMINISTRATIVE EXCEPTIONS; AND TO ESTABLISH PROCEDURES, PERFORMANCE STANDARDS, APPEALS, AND VARIANCES; REQUIRE FEES; PROVIDE FOR ENFORCEMENT, INCLUDING MISDEMEANOR PENALTIES; PROVIDE REPEAL OF CONFLICTING ORDINANCES; AND PROVIDE FOR THE SEVERABILITY, SAVINGS, AND AN EFFECTIVE DATE. SUMMARY: The City of Kootenai adopted Ordinance #214 on 5/2/17 to repeal the current Title 7, Chapter 2, stormwater regulations and adopt a new Title 7 Chapter 2 Grading, Erosion Control, and Stormwater Management Regulations, that provides for: applicability; exceptions; thresholds to establish when stormwater plans must be filed; standards; procedures; maintenance and inspection requirements; opportunities for variances and appeals; and a penalty section, deeming a violation of Title 7, Chapter 2 to be a misdemeanor punishable by a fine not exceeding $1,000 or imprisonment not exceeding 6 months in jail or both, and to allow the city to recover costs for investigation and enforcement of violations. The purpose of the amendment is to reduce or eliminate requirements for small, low-impact projects, to set "trigger-points" when stormwater plans are required, improve the review process and allow for administrative exceptions when warranted. The ordinance is effective upon publication of ordinance summary. NOTICE OF PUBLIC COMMENT PERIOD REGARDING AN APPLICATION FOR A PERMIT TO CONSTRUCT AND OPERATE AN AIR POLLUTION-EMITTING SOURCE PROPOSED ACTION: Quest Aircraft Company, LLC, Sandpoint Idaho, applied to the Department of Environmental Quality (DEQ) for a permit to construct and operate an air pollution-emitting source located at 1200 Turbine Drive, Sandpoint, ID. DEQ has determined that construction and operation according to the proposed permit will not cause or significantly contribute to a violation of any ambient air quality standard and will not injure or unreasonably affect human or animal life or vegetation. DEQ has reviewed the application and completed an analysis of the information submitted by the applicant for the Initial PTC for an aircraft coating operation. Based on this analysis, DEQ proposes to issue the permit to construct to Quest Aircraft Company, LLC. PUBLIC COMMENT PERIOD: Notice is given that DEQ has scheduled a period to receive public comments under Docket No. AQ-1574 concerning the air quality aspects of the project application and the proposed permit in accordance with IDAPA 58.01.01.209.
