CITY OF OLDTOWN ORDINANCE NO. 2020-4 AN ORDINANCE OF THE CITY OF OLDTOWN, BONNER COUNTY, IDAHO, PROVIDING FOR AUTHORITY; PROVIDING FOR ANNEXATION OF LANDS INTO THE CITY; PROVIDING FOR THE ZONING DESIGNATIONS OF THE SUBJECT LANDS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council did conduct public hearings on July 8, 2019 regarding a vacation request for a portion of East Sixth Street North; and WHEREAS, the processing of said vacation request found that, based on available mapping, a short section of the original City limits boundary along the North half of East Sixth Street North may not comply with state code requirements; and WHEREAS, §50-222(2) requires all portions of highways lying wholly or partially within an area to be annexed shall be included within the area annexed; and WHEREAS, the City Council directed staff to bring the subject City limit boundary along East Sixth Street North into compliance with §50-222(2); WHEREAS, City Ordinance 2010-1 Article 3.2B and Article 3.2C provide direction for existing zone boundary interpretations; and WHEREAS, Conformance with §50-1324 is obtained by the subject lands being existing platted public right of way and, hence, no property taxes are assessed or owed; and WHEREAS, the City Council concluded this annexation only involves existing unmaintained public right of way, meets applicable sections of §50-222, and brings City boundary location along East Sixth Street North into compliance with §50-222(2); NOW THEREFORE, THE CITY COUNCIL OF OLDTOWN, IDAHO HEREBY ORDAINS AS FOLLOWS: SECTION 1 Land described in this Section is hereby annexed into the City of Oldtown: A parcel of land located in Section 24, Township 56 North, Range 6 West, Boise Meridian, Bonner County, Idaho depicted on Exhibit A and more particularly described as follows: The north half of East Sixth Street North lying adjacent to Block 6, Lot 1 of the Newport Idaho Plat recorded at Book 1 of Plats, Page 6, Bonner County Records. Less any portion already within the Existing City Limits of the City of Oldtown, Idaho. SECTION 2 Consistent with City Ordinance 2010-1 Article 3.2B and Article 3.2C the Oldtown official zoning map is hereby amended to include and designate the annexed land, consistent with original and current zoning of surrounding lands, as follows: Commercial SECTION 3 The provisions of this ordinance are hereby declared to be individually severable. Should any provisions of this ordinance be declared invalid by a court of competent jurisdiction, such declaration shall not affect the validity of the remaining provisions. SECTION 4 This ordinance shall be in full force and effective upon passage, approval, recording with the Bonner County Clerk and publication according to law.
