Man arrested for aggravated assault

SANDPOINT – A Bonner County man has been charged with aggravated assault after law enforcement officials said he pointed his gun at a man practicing shooting last week on state land in the Priest River area.

Terry Carl Davis, 58, is being held in Bonner County Jail on $10,000 bond for allegedly pointing a gun at a man while he was shooting at an outdoor location on state land. Retired First District Judge Patrick McFadden found probable cause to sustain the charge and issued a no contact order Monday during Davis’s initial appearance.

According to a criminal affidavit by Deputy Matthew Swan, the victim and his son claim Davis drove to shoot on state land on Hoop Loop shortly after they began target practice. The area is not a shooting range. When Davis told the pair to move to a different location, the victim said he responded by telling Davis to leave and asked “what his deal was.”

After he took a couple of steps toward Davis’s vehicle, Davis told one of his dogs to “get” the victim. It was then Davis pointed his pistol at the victim and said “I’ll show you what my deal is,” according to court records. The victim asked Davis if he was pulling a gun on him, and Davis responded, “yeah.” A female witness walked around the corner, Davis put down the pistol and got out of the vehicle. According to court records, the victim told Davis he was calling law enforcement, prompting Davis to leave the scene.

In Davis’s statements to deputies, he said he never unholstered the pistol, and it remained on the dashboard of his vehicle. He told the pair to go to a different location and then the victim became confrontational. When the man took a couple steps toward him, Davis alleges that he put his hand on the firearm which was still on the dashboard. However, the victim “continued to get in his face.” Davis told the man to back up, then he decided to leave the scene because he felt that “somebody could get hurt.”

Davis, who has no previous criminal history, was arrested and booked at the sheriff’s office later that day at his residence, which is not far from the area.

The firearm, a Walther P22, was collected as evidence. A preliminary hearing in front of Magistrate Judge Justin Julian will be held on Oct. 6.
