Bonner County Revised Code An Ordinance of Bonner County, Idaho, setting forth its authority; amending Bonner County Revised Code Title 12 (Land Use Regulations), to make the following changes to the Sections 268 D., E., & F.; Providing for severability, and providing for an effective date. Whereas, Idaho Code, Title 67, Chapter 65, provides for the adoption of land use standards and processes for the purposes of protecting property rights and enhancing property values, together with the purposes of promoting the health, safety, and general welfare of the people and to ensure that the development on land is commensurate with the physical characteristics of the land; and Whereas, The Board of County Commissioners has amended these sections in accordance with Idaho Code 67-6511; and Whereas, Idaho Code 67-6511 provides for the governing board to establish standards to regulate and restrict uses and standards within the varing zone districts in the County; and Whereas, The Board of County Commissioners initiated a review of the Title 12, Sections 215 C., 222 J., and 253.1 C. to identify ways to decrease intensity, expense and processing of land division applications; and Whereas, the Bonner County Planning and Zoning Commission did hold a public hearing October 18, 2018, on the amendment and did recommend approval to the Board of County Commissioners; and Whereas, the Bonner County Board of County Commissioners did hold a public hearing on December 5, 2018, on the proposed amendments to Bonner County Revised Code Title 12, providing notice for such hearings as required by Idaho Code, Title 67, Chapter 65. Now, therefore be it ordained by the Board of County Commissioners of Bonner County, Idaho that the following be and is hereby adopted as an ordinance of Bonner County: Section 1: Authority This Ordinance is adopted pursuant to the authority granted at Chapter 65, Title 67, Idaho Code, and pursuant to the procedural requirements contained at Section 67-6509, Idaho Code. Section 2: Amending Bonner County Revised Code Title 12, Sections 268 D., E., & F.. 12-268: APPLICATION PROCESS, GENERAL PROVISIONS: D. When the planning director has determined the application is complete and in compliance with this title, the planning director shall send copies of the application to public agencies and entities that may be affected by the proposal, including, but not limited to, the health district, fire districts, irrigation or drainage districts, sewer and water districts, school districts, solid waste and transportation agencies and fish and wildlife agencies. The notice shall be sent at least fifteen (15) days prior to the public hearing agencies shall have thirty (30) days to comment on the application. E. Applications for permits within an area of city impact shall be noticed according to the agreements set forth for the individual community. E. When the agency comment period is complete, the planning director shall advise the applicant in writing that the comment period is complete and shall forward to the applicant the agency comments or a summary of the comments. The planning director shall advise the applicant if additional agency information is necessary in order to provide adequate evidence that the proposal meets the standards of this title. If additional agency information is required, the application shall be considered incomplete at the agency level, pending the receipt of the additional information. F. On completion of the public agency review, the planning director shall schedule the application to the next available public hearing before the governing body authorized to consider the application, as provided in this title, allowing sufficient time for public hearing notice. Section 3: Severability The provisions of this Ordinance are hereby declared to be individually severable. Should any provision of this ordinance be declared invalid by a court of competent jurisdiction, such declaration shall not affect the validity of the remaining provisions. A land capability report shall not be required to be submitted for proposals in which all of the following apply: 1. No additional "impervious surface", as defined in section 12-809 of this title, is created; 2. No additional site disturbance is proposed and no additional development will occur on slopes fifteen percent (15%) or greater; 3. No additional sewage disposal services are associated with the proposal; 4. The area in which the proposed use will occur is not located within a 100-year floodplain as determined from the FEMA flood insurance rate maps; or is not located within a mapped wetland as determined from the U.S. fish and wildlife service national wetland inventory maps; or as determined in writing by the U.S. army corps of engineers; 5. Existing structures or uses involved with the proposal have not had a detrimental effect on the subject land and adjacent lands with regard to floods, sewage, drainage, erosion, sedimentation, or geological or surface slippage. 12-253.1: PLANNED UNIT DEVELOPMENT APPLICATION REQUIREMENTS: C. REQUEST FOR QUALIFICATIONS (RFQ) City of Sandpoint Water System Master Plan The City of Sandpoint is requesting proposals from qualified Consultants to provide professional engineering services in support of the Sandpoint Water System Master Plan project. This solicitation is governed by Idaho Code § 67-2320 and shall be administered accordingly. The Water System Master Plan will update and build upon the Sandpoint Water Facility Plan (CH2M Hill, November 2006). The plan will, at a minimum, include: an evaluation of the Sandpoint water distribution, supply and treatment systems to identify deficiencies; development of a new water system hydraulic model; and recommendations and costs for water system needs for a 20-year planning period. The Water System Master Plan is to include a comprehensive Capital Improvement Plan for the planning period by assessing the existing water system and projecting renewal, replacement and new infrastructure needs over that timeframe. Project funding is provided in part by a FY19 Drinking Water Facilities Planning Grant from the Idaho Department of Environmental Quality in the amount of $45,000. The total project budget available for Professional Service fees is $150,000.
